Kratom, or Mitragyna speciosa, is a tropical tree native to Southeast Asia whose leaves contain naturally occurring alkaloids, including mitragynine and smaller amounts of 7-hydroxymitragynine, commonly called 7-OH.

Products made from kratom are sold online and in some retail markets in forms such as loose leaf, capsules, extracts, and Kratom powder. But the fact that a product can be found for sale does not automatically mean it is legally permitted everywhere.

Kratom laws vary substantially between countries and, in some places, between states, provinces, or other local jurisdictions. Rules can also differ depending on whether the issue is possession, sale, importation, manufacturing, or marketing for human consumption.

That makes kratom legality more complicated than a simple “legal” or “illegal” label.

Why Kratom Laws Differ So Much

Countries regulate kratom in different ways because regulators do not all classify the plant or its alkaloids the same way.

Depending on the jurisdiction, kratom may be treated as:

  • A psychoactive substance
  • A botanical product
  • An unapproved food or supplement ingredient

7-OH occurs naturally in kratom leaf in relatively small amounts. However, concentrated or enhanced 7-OH products can contain much higher amounts than would normally occur in botanical kratom.

FDA has specifically warned consumers about concentrated 7-OH products and has taken enforcement action against products such as tablets, gummies, drink mixes, and shots containing elevated or added 7-OH.

In July 2026, the Drug Enforcement Administration began a temporary scheduling process targeting 7-OH above a proposed threshold, along with several synthetic related compounds.

This distinction matters when reading headlines about “kratom bans.” A regulatory action involving concentrated 7-OH does not necessarily mean that natural kratom leaf has been treated identically.

Consumers should look carefully at what substance and product type a particular rule actually covers.

What About Kratom in Europe?

There is no single European Union-wide rule that gives kratom the same legal status in every member country.

Individual countries can regulate kratom, mitragynine, 7-OH, and related products differently. As a result, products may be available in one European market while being controlled or restricted in another.

Commercial availability should not be treated as proof of legality.

Someone considering ordering kratom across borders should check:

  • National controlled-substance laws
  • Food and supplement regulations
  • Import restrictions
  • Customs requirements
  • Rules covering mitragynine and 7-OH specifically

This is particularly important when traveling between neighboring countries because geographic proximity does not mean their drug or supplement laws are the same.

Kratom Laws in Southeast Asia

Some countries have revised older prohibitions or introduced regulatory systems, while others continue to impose substantial restrictions.

Thailand, for example, removed kratom from its national narcotics list in 2021 and subsequently developed rules governing its production and commercial use.

Travelers should never assume that kratom is permitted simply because the plant is native to Southeast Asia or traditionally used there.

The internet makes the legal picture especially confusing because consumers can often view products from sellers located in another country.

A commercial website may allow someone to browse products even when shipment to that person’s jurisdiction is restricted.

Likewise, vendor shipping policies are business policies, not legal determinations.

Other products may contain:

  • Proprietary mixtures
  • Gummies or liquid shots
  • Ingredients not normally present in natural leaf

Those differences can matter from both a health and regulatory perspective.

A rule that applies to botanical leaf may not necessarily apply in exactly the same way to concentrated products. Likewise, an enforcement action against high-7-OH products should not automatically be interpreted as applying identically to every traditional kratom product.

Consumers should read ingredient information carefully rather than relying only on the word “kratom” on the front of a package.

A product can be legal to possess and still carry health risks.

FDA has warned about serious adverse events associated with kratom use, including substance use disorder, seizures, and liver toxicity. Regulators have also previously identified contamination concerns involving some kratom products.

Legality therefore should not be interpreted as a guarantee that a product is safe, effective, or medically appropriate.

There are currently no FDA-approved kratom products for treating pain, anxiety, opioid withdrawal, substance use disorder, or other medical conditions.

People considering kratom for a health problem should discuss the issue with an appropriate healthcare professional rather than replacing established treatment with a product based primarily on marketing claims or online testimonials.

Traveling With Kratom Requires Extra Caution

Travel presents one of the clearest situations in which outdated legal information can create problems.

Before carrying kratom across a state or international border, check the rules for:

  1. The place you are leaving
  2. Any country or jurisdiction through which you will transit
  3. Your final destination
  4. Customs and import requirements
  5. The particular form of kratom you are carrying

Do not assume that a product purchased legally at home can legally enter another country.

Rules can also change between the time a trip is booked and the date of travel.

When there is uncertainty, leaving the product behind is safer than relying on an unofficial online list.

Because regulations change, the strongest sources are usually current government or regulatory websites.

Depending on the location, useful sources may include:

  • National health ministries
  • Controlled-substance authorities
  • Customs agencies
  • Food and drug regulators
  • State or provincial government websites
  • Official legislation databases

Check the publication or update date whenever possible.

A blog post or country list can provide a starting point, but it should not be treated as the final authority when possession, importation, or criminal penalties may be involved.

The Bottom Line

There is no single worldwide answer to whether kratom is legal.

Its status depends on the jurisdiction, the specific product, how it is marketed, and sometimes the concentration of individual alkaloids such as 7-OH.

In the United States, botanical kratom is not currently scheduled nationwide as a federal controlled substance, but FDA does not consider kratom lawfully marketed as a dietary supplement, conventional food ingredient, or approved medication. State and local rules add another layer.
