10 Questions You Should Ask Before Hiring an Attorney

Hiring a lawyer to represent you is not a common practice for most people, so when they go searching for an attorney, lawyer advertising that doesn't inform the legal consumer often tricks them. They are lured in by fistfuls of cash and slogans like “No fee if no recovery.”

To make the best choice for yourself, or your loved ones, there are 10 questions to ask potential attorneys to give you a higher chance of success in hiring the right attorney for your needs.

1. Are you board certified? Not every state has a board certification process, including Virginia. However, they often recognize several national certification groups, like the National Board of Legal Specialty Certification, on the web at www.NBLSC.us.

2. What is your AVVO rating? This is one of several independent consumer attorney-rating services. You should explore this website to read reviews from past clients and other attorneys in the area.

3. Are you in Best Lawyers in America? Find out at www.BestLawyers.com.

4. Are you in Super Lawyers? Find out at www.SuperLawyers.com.

5. Do you have real testimonials? Skilled attorneys who provide positive customer experiences can produce testimonials from satisfied clients.

6. Can you send me your information package before we meet? Many attorneys have authored books, recorded CDs, and created informational DVDs that are helpful to consumers. They should address issues within the practice area and should be understood by you easily. This information can't take the place of an in-person meeting, but most experienced attorneys have information like this readily available.

7. Can you give me a full, written settlement evaluation of my injury case before we attempt negotiations? For most types of cases, you should be able to get a full written outline of the “risks and benefits” of going forward with the case.

8. Are you a specialist or generalist? Each area of the law is complex and has its own set of nuances and rules. Specialists can navigate your case to a successful conclusion and will likely be better positioned to explain the process to you.

9. Do you have a track record of success in cases like mine? You should be able to see lists of previous settlements, and possibly find it on the attorney's website. While some people may be concerned about attorneys “cheating” in this area, this is one of the most highly regulated portions of an attorney's website in Virginia.

10. Will you give me the names of three other attorneys you would trust with my case? This is the “silver bullet” question. If you do several interviews and find names repeated on the list, it is a good bet those are good, respected attorneys appropriate for your case.

Every case is different, but the questions above should help you in most legal situations you encounter. The relationship with your attorney could last from months to years, so make sure you are confident you're getting the right person for the job.
